Dijstra Ltd is a company registered in England and Wales under company number 09359459.

1. Digital Product Purchases

1.1 Products and descriptions

Dijstra Ltd develops and supplies digital products, including downloadable tools, spreadsheets, templates, guides and other electronic resources.

Digital products are supplied electronically. No physical product will be dispatched unless explicitly stated in the product description.

We aim to describe each product accurately, including its features, file format, compatibility and any relevant technical requirements. Customers should review this information before purchasing.

1.2 Payments and order processing

Digital product purchases are processed through Creem, which acts as the Merchant of Record for these transactions.

Creem handles checkout, payment processing, applicable transaction taxes and payment-related documentation in accordance with its own terms and policies.

Prices, currencies and applicable tax arrangements are displayed during checkout. The final amount payable is confirmed before the customer completes their purchase.

Dijstra Ltd remains responsible for the digital products it develops and supplies, subject to applicable law and the arrangements governing the transaction.

1.3 Digital delivery and download access

Digital products are made available electronically following successful payment, normally through download instructions or links provided by Creem.

Download links may expire or be subject to security measures administered by Creem. The duration and operation of these measures may vary.

Customers should download their purchased files promptly and retain a backup copy for future use.

Where supported by Creem, customers may recover access to their purchases through the Creem Customer Portal, including by requesting a new login link using the email address associated with their order.

Customers experiencing difficulty accessing a purchased product may contact Dijstra Ltd for assistance.

We do not guarantee that an individual download link will remain active indefinitely or that digital files will remain hosted permanently. This does not affect customers' statutory rights or any legal obligation to provide the purchased digital content.

1.4 Product licences and permitted use

Unless a product states otherwise, Dijstra Ltd digital products are supplied under the Dijstra Ltd Standard Digital Product Licence included with the purchased files.

The standard licence permits use of the purchased version for personal, household, family and internal business purposes, including reasonable working copies and backups.

Customers may use products on multiple devices and in different locations, subject to the licence conditions. Ordinary client work and the sharing of outputs created through permitted use are allowed.

Purchasing a digital product does not transfer ownership of its copyright, source code, underlying design or intellectual property.

Reselling, redistributing or repackaging supplied files or substantial instructions, publishing the tool itself online, or commercially selling generated output products as standalone products requires separate permission.

Additional commercial licensing or customisation may be available by arrangement.

The purchased version may be used indefinitely in accordance with its licence. Future upgrades, additional versions, hosting and ongoing technical support are not automatically included unless expressly stated.

1.5 Compatibility and product support

Customers are responsible for checking the stated system requirements and compatibility information before purchase.

Some products require compatible software, applications or web browsers. Dijstra Ltd cannot guarantee compatibility with every device, operating system, application version, printer or third-party service.

Where a product does not function substantially as described, customers should contact us with details of the difficulty so that we can investigate and, where appropriate, provide assistance or a suitable remedy.

1.6 Refunds and consumer rights

Because digital products are delivered electronically and may be accessed immediately, cancellation and refund arrangements can differ from those applicable to physical goods.

Any cancellation or withdrawal rights relating to immediate digital delivery will be governed by applicable consumer law, including any requirements for customers to give express consent and acknowledgement during checkout.

A digital purchase is not automatically non-refundable merely because a download link has been issued or a file has been downloaded.

Customers retain any mandatory legal rights relating to faulty digital content, products that are not as described, non-delivery and other circumstances where a refund, repair, replacement or other remedy is required by law.

Refund requests may be submitted through the applicable Creem support or order-management process, or by contacting Dijstra Ltd.

Nothing in these Terms excludes or restricts statutory consumer rights.

2. Services

2.1 Scope of services

Dijstra Ltd provides professional services that may include website design and development, website configuration, digital systems, technical assistance, consultancy and related work.

The exact scope of an engagement will be agreed through a written quotation, proposal, service agreement or other written correspondence.

Where there is a conflict between these general Terms and specific written conditions agreed for a project, the project-specific conditions will take precedence to the extent permitted by law.

2.2 Quotations and project arrangements

Quotations are prepared using the information available at the time and may be subject to assumptions, exclusions and agreed client responsibilities.

Any material change to the scope of a project may require an updated quotation, additional fees or an adjustment to the delivery schedule.

Project timescales are estimates unless expressly agreed otherwise and may depend on the timely provision of information, content, approvals, access or other materials by the client.

2.3 Payment terms

Unless otherwise agreed in writing, project-based website and digital systems work is payable as follows:

  • 50% before work begins.

  • 50% before project completion and final handover.

Alternative arrangements may be agreed for smaller assignments, hourly work, recurring services or ongoing support.

Service payments may be processed through Squarespace Payments where an appropriate online payment facility is offered. Other services may be invoiced directly by Dijstra Ltd and paid by bank transfer.

Payment arrangements, deadlines and any applicable taxes will be confirmed in the quotation or invoice.

2.4 Client responsibilities

Clients are responsible for supplying accurate information, suitable content, necessary permissions and reasonable access to systems required for the agreed work.

Clients must ensure that material they provide is lawful and that they have permission to use it.

Delays caused by missing information, access difficulties or outstanding approvals may affect delivery dates.

2.5 Changes, cancellations and refunds

Clients may request changes or cancellation of an agreed project by contacting Dijstra Ltd.

Where a project is cancelled after work has begun, Dijstra Ltd may charge a reasonable amount for work already completed, time reasonably committed and unavoidable costs incurred, subject to applicable law and the agreed project terms.

Any amount already paid will be reconciled against those charges, with any balance refunded where appropriate.

Payments made in advance are not automatically non-refundable.

Where a client has statutory cancellation rights, including applicable consumer rights for services purchased remotely, those rights will be respected. Any requirements relating to requests for work to begin during a cancellation period will be handled in accordance with applicable law.

2.6 Intellectual property and handover

Ownership, usage rights and transfer of deliverables will be determined by the agreed project terms.

Unless otherwise agreed, Dijstra Ltd retains ownership of its existing methods, reusable tools, templates, software components and other pre-existing intellectual property.

Rights in client-provided materials remain with their respective owners.

Third-party software, themes, extensions, fonts, images and platform services remain subject to their own licensing arrangements.

Any transfer of agreed project deliverables or associated rights will take place in accordance with the project agreement and applicable payment obligations.

2.7 Third-party platforms

Some services involve third-party platforms, including website builders, hosting providers, payment services, extensions and other software.

These platforms may have their own terms, charges, technical limitations and service availability arrangements.

Dijstra Ltd is not responsible for changes made independently by third-party providers, but will aim to explain relevant dependencies when they materially affect the agreed service.

3. Hosting, Security & Maintenance

3.1 Hosting and maintenance services

Dijstra Ltd may provide managed website hosting, maintenance, backups, software updates, security assistance and associated technical support.

The precise services included, fees, billing intervals and any support limitations will be stated in the relevant service agreement or quotation.

A hosting or maintenance arrangement does not automatically include unlimited development work, content updates, emergency support or third-party subscription fees unless expressly agreed.

3.2 Website content and acceptable use

Clients are responsible for the content and lawful operation of websites hosted or maintained on their behalf.

Dijstra Ltd does not knowingly provide hosting services for websites primarily intended to facilitate unlawful activities or distribute unlawful content.

Dijstra Ltd may also decline or discontinue hosting for websites whose primary purpose involves:

  • The unlawful sale or promotion of drugs or other prohibited goods.

  • Explicit pornographic or adult entertainment content.

  • The promotion of hatred, discrimination or harassment.

  • Political campaigning or organised political advocacy.

These are service eligibility restrictions and do not automatically prohibit lawful educational, medical, journalistic, artistic or factual discussion of sensitive subjects.

Dijstra Ltd reserves the right to assess whether a proposed website is compatible with the services it is willing to provide.

Where a concern arises during an existing service arrangement, we will act reasonably and proportionately, taking into account applicable law, the seriousness of the issue and the relevant contractual terms.

3.3 Security and maintenance

Reasonable care will be taken when performing agreed maintenance and security-related tasks.

However, no website, server or software system can be guaranteed to be completely secure, continuously available or free from faults.

Security arrangements may depend on third-party hosting providers, website software, extensions, passwords, client activity and other factors outside Dijstra Ltd's direct control.

Clients remain responsible for maintaining suitable access controls and for following reasonable security guidance.

3.4 Backups and recovery

Where backups are included in a service, the scope and frequency of those backups will be determined by the agreed hosting or maintenance arrangement.

Backups reduce operational risk but do not guarantee the recovery of every file, transaction or website change in every circumstance.

Clients are encouraged to retain their own independent copies of important business information and materials where appropriate.

3.5 Fees, renewal and termination

Hosting and maintenance services are charged according to the agreed service terms and billing arrangements.

Renewal periods, cancellation notice, payment deadlines and any applicable termination charges will be set out in the specific service agreement.

On termination, Dijstra Ltd will explain any applicable arrangements for website files, backups, domain access and reasonable assistance with transfer to another provider.

Any migration or transfer work outside the agreed service may be quoted separately.

Termination and data handling will remain subject to applicable contractual and legal obligations.

Dijstra Ltd will exercise reasonable care and skill when supplying its services and digital products.

To the extent permitted by law, Dijstra Ltd will not be liable for losses resulting from circumstances outside its reasonable control or from misuse of products or services contrary to their stated requirements and instructions.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including liability for fraud, death or personal injury caused by negligence, or liability arising under mandatory consumer protection legislation.

Any additional limitations of liability for a particular business service must be reasonable, lawful and agreed as part of the relevant contractual arrangements.

4.5 Privacy and personal information

Personal information is handled in accordance with the Dijstra Ltd Privacy Policy and applicable data protection laws.

Third-party services involved in website operation, payment processing and order fulfilment may also process information under their own applicable policies.

For further information, please see our Privacy Policy.

4.6 Changes to these Terms

Dijstra Ltd may update these Terms & Conditions to reflect changes in its products, services, business arrangements or legal requirements.

The current version and effective date will be displayed on this page.

Changes will not retrospectively remove rights already acquired by customers or alter existing contractual commitments without an appropriate legal basis.

4.7 Governing law

These Terms are governed by the laws of England and Wales, subject to any mandatory consumer protections or other legal provisions that apply in the customer's jurisdiction.

Nothing in this provision removes rights that customers are entitled to exercise under applicable mandatory law.
